Please read these Terms of Use (“Terms”) carefully before using any of the services provided by HIIT BOX, LLC. These Terms include HIIT BOX, LLC’s Privacy Policy, which is incorporated by reference into these Terms.
BINDING AGREEMENT. These Terms constitute a binding agreement between you and HIIT BOX, LLC d/b/a HIIT BOX (hereinafter referred to as “HIIT BOX,” “We,” “Us”). “You” and “User(s)” mean all visitors to HIIT BOX and all persons who use HIIT BOX’s services, including a minor child under your care as a parent adult and/or legal guardian on behalf of such minor child. HITT BOX services consist of group and/or individual fitness classes and related services (“HIIT BOX Services”). You accept these Terms each time you visit HIIT BOX or utilize HIIT BOX Services, including, but not limited to, participating in, HIIT BOX fitness classes. If you do not accept these Terms, you must not use the services of HIIT BOX.
REVISIONS TO TERMS. HIIT BOX may revise these Terms at any time by posting an updated version to HIIT BOX’s website at http://www.bkhiitbox.com (“HIIT BOX’s Website” or “Site”). You should visit this Site periodically to review the most current Terms because you are bound by them. Your continued use of HIIT BOX Services after a change to these Terms constitutes your binding acceptance of these Terms.
PURCHASE POLICY. Classes and instructor assignments are subject to change. All class prices are subject to change. All class packages are non-transferable and non-refundable; there are no exceptions. Single classes expire one month from the date of purchase. 3 and 5 class series packages expire 3 months from date of purchase. 10 class series packages expire 6 months from the date of purchase. 15-class series package expires 9 months from the date of purchase. 20 class series packages expire 1 year from the date of purchase. For health and safety reasons we ask that you limit yourselves to 2 classes per day. Class participants in an adult class must be 16 years of age or older. Class participants in a youth class must be 11 years of age or older, unless otherwise agreed. A parent and/or legal guardian must provide the prior written consent on a form we provide before the participation in or usage by any minor in a HIIT BOX Service.
CANCELLATION POLICY. HIIT BOX cancellation policy requires you to cancel a reservation 12 hours before your scheduled session. Late cancellations or no shows will be charged for the session accordingly. This is a very generous window, so please be courteous to other members and cancel when you know you can’t make it. To cancel a class, please log into your online account and click the cancel button or call/text/email HIIT BOX and we’ll gladly assist you.
WAIT-LIST POLICY. If you are unable to get into a HIIT BOX class you want because it is fully booked, we highly recommend putting yourself on the waitlist. Spots do open up and they are assigned to clients on the waitlist in the order in which they signed up. You must purchase a class package BEFORE you can reserve a spot on the waitlist. If you don't receive a spot in your desired class, your class credits remain in your account for future use.
If a spot becomes available for a HIIT BOX class you have been waitlisted for, you will automatically be enrolled and receive an email confirmation stating you have received a spot for the HIIT BOX session you requested. Please note that if you are no longer interested in a class for which you are on the waitlist, you must remove yourself from the waitlist (online or by calling the studio and speaking with someone live, emailing to texting and getting a response) or you risk being enrolled and charged whether or not you attend.
We will not enroll anyone until we get a response back. The first wait-listed client who either calls, texts or emails will be enrolled regardless of their order on the waitlist. Spots become available from a no show at class time so if you’re in the ‘hood - drop by and snag a last minute spot. Your account will be charged upon confirmation of a spot in class. If you are running late and we have not heard from you by the start of class, any waitlisted client who is physically present will take the place your spot.
PRIVACY POLICY. HIIT BOX respects your privacy. The Privacy Policy explains our practices relating to collection, use and disclosure of information that you may provide to HIIT BOX, including through this Site. Before you submit any personal information to HIIT BOX through this Site or otherwise, please thoroughly review this Privacy Policy, and contact us if you have any questions.
Please note that this Privacy Policy governs information provided to HIIT BOX, including information you provide to us on HIIT BOX’s Website. Your use of HIIT BOX’s Website and HIIT Box Services constitutes your acceptance of this Privacy Policy and your consent to the practices it describes.
HIIT BOX will not sell or rent your personal information to anyone, for any reason, at any time. HIIT BOX will use and disclose your personal information only as follows:
1. Comply with legal process, such as a court order or subpoena;
2. Enforce these Terms;
3. Respond to claims that any content violates the rights of third parties;
4. Respond to your requests for customer service;
5. Respond to law enforcement;
6. Investigate and prevent unauthorized transactions or other illegal activities; or
7. Protect the rights, property, or safety of HIITBOX, its users, and the public.
8. To analyze Site usage and improve the service;
9. To fulfill your requests and orders for certain products and services;
10. For market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity; and/or
11. To third-party contractors that provide services to HIIT BOX and are bound by these same privacy restrictions;
WAIVER & RELEASE. By using HIIT BOX Services, you acknowledge that that there are certain inherent risks and dangers in physical exercise and that the classes you may attend offer a range of activity and intensity levels. You acknowledge and agree that it is your responsibility to consult with your primary care physician prior to participating and to determine if and how participating in any class or service is appropriate for you. By using HIIT BOX services, you acknowledge and agree, on behalf of yourself, your heirs, personal representatives and/or assigns that you are aware of these risks, that you are fully informed of the potentially strenuous nature of this exercise program and the possibility of adverse physiological occurrences including, but not limited to, property damage, abnormal blood pressure, fainting, heart attack or death. You acknowledge that some of these risks cannot be eliminated and you specifically assume the risk of injury or harm.
Therefore, to the fullest extent permitted by law, you release, indemnify, and hold harmless HIIT BOX, its parent, subsidiaries or affiliated entities, and each of their respective officers, directors, members, employees, consultants, contract employees, representatives and agents, and each of their respective successors and assigns, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages and liabilities arising out of or in any way related to your participation in or use of HIIT BOX Services, including with respect to bodily injury, physical harm, illness, death or property damage.
You acknowledge that your agreement to this release applies to each time you visit HIIT BOX or utilize HIIT BOX services. You hereby acknowledge that you, and any minor under your care, have voluntarily chosen to participate in HIIT BOX Services.
